Terms of Service

By creating an account or using DudleyGym, a product wholly owned and operated by DH76 LLC (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

DudleyGym is an AI-powered personal training application that generates customized workout plans based on your fitness profile, goals, available equipment, and workout history. The Service includes:

• AI-generated workout plans and exercise recommendations
• Workout tracking and progressive overload management
• Virtual trainer personas powered by artificial intelligence
• Cardio session logging
• Optional SMS notifications and workout sharing

You must create an account to use the Service. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement.

This is important — please read carefully.

DudleyGym uses artificial intelligence (powered by Anthropic Claude) to generate workout plans, exercise recommendations, weight suggestions, and trainer responses. You understand and agree that:

• Not medical advice: AI-generated workouts are not a substitute for professional medical advice, physical therapy, or personal training from a certified professional. Always consult a qualified healthcare provider before starting any exercise program.
• Exercise at your own risk: You assume full responsibility for any injuries or health consequences resulting from following AI-generated workout plans. You should stop exercising immediately if you experience pain, dizziness, or other concerning symptoms.
• AI limitations: While our AI follows evidence-based exercise science guidelines, it cannot account for all individual health conditions, biomechanical limitations, or medical histories. The AI may occasionally suggest exercises that are inappropriate for your specific situation.
• Weight recommendations: AI-suggested weights are estimates based on your history. Always start lighter than suggested if you are unsure, and never sacrifice form for heavier weight.
• Per-session consent: You must acknowledge and accept a liability disclaimer before each workout session. This is a legal requirement and cannot be bypassed.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service
• Share your account credentials with others
• Impersonate another person or entity

If you opt into SMS features, additional terms apply as described in our SMS Terms & Conditions. Message and data rates may apply. You can opt out at any time by replying STOP or disabling SMS in your account settings.

The DudleyGym name, logo, design, and software are the property of DH76 LLC. AI-generated workout plans are provided for your personal use only and may not be commercially redistributed. Your fitness data remains your property.

To the maximum extent permitted by law, DH76 LLC, DudleyGym, and their officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Physical injury or health consequences from following workout recommendations
• Loss of data or service interruptions
• Errors or inaccuracies in AI-generated content
• Unauthorized access to your account

Our total liability for any claims arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

You may delete your account at any time through the app settings or by contacting support. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be permanently deleted within 30 days.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
